Terms & Conditions  for Conscious360.com

Welcome to Conscious360, a social networking and business-building service that allows Members to promote businesses and events, and create unique personal and business profiles online.  The services offered by Conscious360 (“Conscious360 Services” or “Service”) include the Conscious360.com web site, and any other features, information or content (“Content”), or applications offered in connection with the conscoius360.com web site or any web site operated or maintained by Conscious360, LLC and its corporate affiliates (collectively, the “Conscious360 Website”, “Website” or “Site”).  Conscious360 Services are operated by Conscious360, LLC and its corporate affiliates (collectively, "us", "we", the “Company" or “Conscious360”).

This Terms of Use Agreement ("Terms of Use" or "Agreement") sets forth the legally binding terms for your use of the Conscious360 Services.  By accessing or using our Site, or by linking to the Site from any other web site, you (the "User" or “Member”) signify that you have read, understand and agree to be bound by these Terms of Use and any applicable laws (whether or not you are a registered member of Conscious360).

We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice.  The date of the latest revision of these Terms of Use is located on this page, and the Terms of Use in their latest revision are considered effective on that date.  Your continued use of the Service or the Site constitutes your acceptance of the Terms of Use in its latest revision.  If you do not agree to abide by these or any future Terms of Use, you are not authorized to use or access the Site.  It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

This Agreement includes Conscious360’s policy for acceptable use of the Conscious360 Services and any information or content posted on the Site, and your rights, obligations and restrictions regarding your use of the Conscious360’s Services.

BY YOUR USE OF THE CONSCIOUS360 SITE OR SERVICES, CONSCIOUS360 ASSUMES THAT YOU HAVE READ AND UNDERSTAND THE INFORMATION CONTAINED HEREIN AND AGREE TO THESE TERMS OF USE.

1. Eligibility

Membership in the Conscious360 Service is void where prohibited.  This Site is intended solely for Users who are eighteen (18) years of age or older.  By using Service or the Site, you represent and warrant that (a) you are 18 years of age or older; (b) all registration information you submit is truthful and accurate; (c) you will maintain the accuracy of such information; (d) your use of the Conscious360 Services does not violate any applicable law or regulation; and (e) you have the right, authority and capacity to enter into this agreement, and you agree to and will abide by all of the terms and conditions of this Agreement.  You are fully responsible for all use of your account and for any actions that take place using your account.  Your profile may be deleted and your Membership may be terminated without warning if we believe that you are in violation of any terms or conditions of this Agreement.

1.1 Alcohol. Conscious360 events and third party events advertised anywhere on the Conscious360 Site or in Conscious360 materials may include the serving of alcohol.  All such events are in all cases considered to be for persons 21 years of age and older, whether or not that is expressly stated anywhere.  Some Conscious360 advertisements, profiles, or other material on the Conscious360 Site may contain references to alcohol.  Any promotion or advertising of events serving alcohol, or products, services or material having to do with alcoholic beverages, is considered to be for persons 21 years of age or older only, and are assumed to be off-limits to anyone under 21 years of age.  If you are under the age of 21, you represent and warrant that you will not promote, sell or post any event, product or service having anything to do with the sale, serving or consumption of alcohol on this Site, you will not attend or associate with any Conscious360 event or third party event promoted through Conscious360 where alcohol is served, nor will you assume that any event, product or service promoting or referencing alcohol constitutes Conscious360’s endorsement of the consumption of alcohol, or permission to participate in the sale, consumption or promotion of alcohol.  

1.2 NO GARUANTEE. SATISFYING THESE CONDITIONS FOR ELIGIBILITY, AND/OR AGREEING TO OR ABIDING BY THIS AGREEMENT, DOES NOT OBLIGATE CONSCIOUS360 TO PROVIDE ANY PRODUCT OR SERVICE FOR YOU.  CONSCIOUS360 RESERVES THE RIGHT TO DENY OR CANCEL MEMBERSHIP FOR ANYONE, FOR ANY REASON, WITHOUT NOTICE, WITHOUT YOUR CONSENT, AND WITHOUT LIABILITY.

2. Term

This Agreement will remain in full force and effect while you use the Site and/or are a Member.  You may terminate your membership at any time for any reason.  If you have paid for your membership and you terminate your membership before the full term of your subscription, you are not entitled to any refund of unused subscription fees or any other fees.  We may terminate your membership for any reason at any time.  One reason we may terminate your account is the receipt of a complaint or negative feedback regarding you, your business, your profile or your activities from another member.  If we terminate your account, you will not be entitled to any refund of unused subscription fees or any other fees.  Even after your membership is terminated, you are still bound by these Terms of Use.

3. Third Party Services

The Site contains links, applications, references to and integration with some third party web sites, services and content (collectively, “Third Party Materials”).  Please note that, if you use any third party features, then you may be required to agree to terms of use with those third parties as well.  Any such terms of use are different from and in addition to this Agreement.

Any links, references to, or integration of any kind to Third Party Materials are provided by Conscious360 solely as a convenience.  Conscious360 neither endorses nor bears any responsibility for or control over any Third Party Materials that appear in or are associated with this Site.

Once you leave the Site and/or access Third Party Materials, Conscious360 bears no responsibility for the quality of your experience.  Conscious360 cannot and will not police or endorse the quality or appropriateness of all links or Third Party Materials that appear in or are associated with the Site.

4. Proprietary Rights in Content

Content on the Site and available through the Service, including information, text, pictures, logos, deigns, video, applications, software, sound and other files (the "Site Content"), are the proprietary property of the Company, its users or its licensors with all rights reserved.  Except for any information which is in the public domain or content posted by you, you may not use, sell, modify, copy, publish, distribute or display any content, proprietary materials or information without the express written consent of Conscious360 for each case.

By displaying or publishing any of your own content, including but not limited to articles, profile information, and images (collectively “User Content “), on or through the Conscious360 Services, you represent and warrant that you have the right to grant to Conscious360 a limited license to use, modify, copy, display and distribute such User Content on and through the Conscious360 Services and associated third party services.  Conscious360 reserves the right to edit, modify, change, replace or delete any content or portion thereof that you post to the Site.  This license is non-exclusive, fully-paid and royalty-free.  Conscious360 does not and will not claim ownership rights to any content you post to the Site, unless another agreement between you and Conscious360 is in effect, which grants Conscious360 ownership rights to specific User Content.

You are granted a limited license to access and use the Site and the Site Content for personal and non-commercial purposes, or commercial purposes where expressly allowed, provided that you are eligible for use of the Site.  You are bound to abide by copyright law, trademark law, and all other laws governing any content on the Site when accessing and using the Site and Site Content.  Nothing in these Terms of Use shall be construed as permission or endorsement by Conscious360 to violate this Agreement or any law.  Any use of the Site other than as specifically authorized herein, without the prior written permission of Conscious360, is strictly prohibited and will terminate the license granted herein.  Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights.  This license is revocable at any time without notice and without cause.

5. Commercial and Non-Commercial Use by Users
Conscious360 endorses the use of its Services for the promotion of your business, products and services, within certain limits.  Provided that a) you are an owner, member or employee of the business you are promoting; b) you are not violating this Agreement or any Conscious360 policy; c) you have express permission from the business you are promoting to do so; and d) you are not violating any policies or agreements with the business you are promoting, you may consider the following to be valid uses of Conscious360 Services to promote your business, product or service:

•    Posting advertisements or affiliate links for your business in your profile
•    Promoting products or services in your profile or blog
•    Posting your company’s events to the event calendar
•    “Linking” with other businesses by referring or accepting referrals within the bounds of the Site’s referral network
•    Other activities, at your discretion, which are not prohibited by these Terms of Service.

PLEASE NOTE: COLLECTING USERNAMES AND/OR EMAIL ADDRESSES OF CONSCIOUS360 MEMBERS BY ELECTRONIC OR OTHER MEANS FOR THE PURPOSE OF SENDING UNSOLICITED EMAIL OR UNAUTHORIZED FRAMING OF OR LINKING TO THE SITE IS PROHIBITED.

You may not use your profile page to capture data from any User.  

You may not directly sell products or services from your profile, blog or any other User Content.  For example, if you are selling Goji Juice, you may not construct your profile page to look like an e-commerce web site for Goji Juice, with price listings and a “buy now” button for Goji Juice.  Your profile page should not resemble an E-Bay page, Craig’s List page, e-store, or any other e-commerce style page designed to directly sell products.  Your profile page is informational only.

You may not promote, advertise or make reference to illegal activities, such as gambling, prostitution or drug trafficking anywhere on the Site or Service.  

Appropriate legal action will be taken for any illegal or unauthorized use of the Conscious360 Services.

6. Content Posted by User

You represent and warrant that: a) you own the User Content posted by you on or through the Conscious360 Services or otherwise have the right to grant the license set forth in Section 4, and b) the posting of your User Content on or through the Conscious360 Services does not violate the copyrights, contract rights, privacy rights, publicity rights or any other rights of any person. You agree to pay for all royalties and fees owing any person by reason of any User Content posted by you to or through the Conscious360 Services.

Any information you provide to Conscious360 in any form may be publicly viewable by anyone, unless otherwise and expressly noted in writing by Conscious360.  Moreover, any information you provide to Conscious360 may exist forever in some form on the Internet.  Even if you delete the information from your profile, or your membership is terminated, any information you provide to Conscious360 may remain intact in a database somewhere on the Internet, for example in Conscious360’s own back-up data storage devices, or in Google’s website archives, even if it is not viewable on the Site.  This is a universal and largely unavoidable phenomenon of the Internet.  Conscious360 takes reasonable measures to ensure the privacy and security of personal data; however, Conscious360 assumes no responsibility for the storage or dissemination of personal information by means that are outside of the Company’s reasonable control.

For these reasons, and by means of preserving your own privacy and security, Conscious360 encourages you to choose carefully the information you post on the Site or Third Party Materials.  While you are required by these Terms of Use to provide accurate information to Conscious360, and maintain the accuracy of that information, you are not required to provide more than the minimum data necessary to build and maintain your profile or other Services.  Examples of data that may become publicly viewable via the Conscious360 Service include, but are not limited to:

•    First and last name
•    Business name
•    Gender
•    Age
•    Location
•    Phone number
•    URL of your business, member profile, personal web site, etc.

Some data you provide to Conscious360 will appear automatically in your profile page, on the events calendar, or in some other part of the Site.  Some of this data may not be removable by you or by Conscious360, as it is considered the minimum data necessary to maintain a profile, event calendar listing, or other Service.  Conscious360 reserves the right to determine what User information is always and automatically displayed, and this data may not be removed or deleted while your membership is active.  Failing to supply this minimum data upon request may result in your inability to utilize certain Services on the Site, or the termination of your Membership.  The bullet list above provides examples of the types of data Conscious360 may consider to be the minimum data necessary to use certain Services.

You are solely responsible for the User Content that you post on or through any of the Conscious360 Services, and any material or information that you transmit to other Users and for your interactions with other Users.  Conscious360 does not endorse and has limited or no control over any User Content.  User Content is not necessarily reviewed by Conscious360 prior to posting and does not reflect the opinions or policies of Conscious360.

Conscious360 assumes no responsibility for User Content, no obligation to modify or remove any inappropriate User Content, and no responsibility for the conduct of the User submitting any such User Content.  This applies to content posted by you or any User.

Conscious360 reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the Site or Services at any time, for any or no reason, with or without prior notice, and without liability.

Conscious360 allows Users to use their profiles to promote a single or multiple businesses, products, services, or an individual person.  A single User may construct multiple free and/or paid profiles by opening multiple accounts.  You must disclose the identity of all your Conscious360 accounts to Conscious360 each time you create a new account.  If you fail to disclose your other accounts to Conscious360, Conscious360 reserves the right to terminate all your accounts without notice.  If you violate any provision in these Terms of Use on any one account, all accounts owned by you will be subject to the same penalties, up to and including the termination of all your accounts.  

7. User Content

Posting Content that is illegal or prohibited on this Site may result, in our sole discretion, in termination of your membership.  Conscious360 reserves the right to investigate and take appropriate legal action, in our sole discretion, against anyone who violates this provision, including, without limitation, removing the offending communication from the Website and reporting such violator to the appropriate legal authorities.  Prohibited Content includes but is not limited to Content that, in our sole judgment:
•    violates guidelines laid out anywhere in these Terms of Use, on the Conscious360 Site or in Conscious360 materials.  For example, some Conscious360 contributors are provided article submission guidelines that are not included in these Terms of Use;
•    contains false, misleading or fraudulent information;
•    is patently offensive, such as any Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
•    violates the law or anyone’s rights, including intellectual property rights or other proprietary rights;
•    harasses or abuses or advocates harassment or abuse of another person;
•    is threatening, obscene, defamatory or libelous;
•    exploits people in a sexual or violent manner;
•    solicits personal information from anyone under 18;
•    displays profane, violent, pornographic or sexually suggestive material or links to such material, such as a link to an adult website;
•    contains contact information or private information of any unconsenting third party;
•    involves the transmission of  any unsolicited mass mailing, emailing or other communication;
•    constitutes or includes any illegal or unauthorized copy of another person's copyrighted or copyrightable work;
•    promotes illegal activity or contains information about illegal activity;
•    solicits passwords or personally-identifying information for commercial or unlawful purposes from other Users;
•    solicits people or businesses you do not know to add you or accept you as a “friend,” “fan,” “referral,”or any sort of connection on the Service that links you to a third party;
•    promotes, sells, advertises, serves, or encourages the consumption of, alcoholic beverages to persons under the age of 21.

You understand and agree that despite the prohibition of these and other prohibited or illegal activities, you may become exposed to such items while using the Site or the Service.  If so, neither Conscious360 nor any of our officers, directors, employees, shareholders, contributors, advertisers or corporate partners will in any way be responsible for any damages incurred or suffered by any party or caused by any party arising out of or related to any such exposure.

8. User Conduct
      The following is a partial list of the kind of activity that is illegal or prohibited on the Conscious360 Site and through your use of the Conscious360 Services.  Conscious360 reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to:
 
•    any activity that could overburden, impair or disable the proper working of the Conscious360 Service;
•    use of any robot, spider, scraper or other automated means to access the Conscious360 Service;
•    harvesting, using or collecting personal or business information such as addresses, phone numbers or email addresses for any purpose other than to contact the person or business with the intention of personal patronage;
•    sending spam or any unsolicited or bulk advertisements through the Conscious360 system;
•    abusing the Conscious360 system in order to harass another User, for example, writing multiple negative testimonials for a single User;
•    the sending of or linking to harmful viruses or files;
•    criminal activity, including fraud, child pornography, drug dealing, gambling, harassment, spamming, sending of viruses or other harmful files, or copyright infringement;
•    providing false or misleading personal or business information;
•    using any information obtained from the Conscious360 Services in order to contact, advertise to, solicit, or sell to any User without their prior explicit consent;
•    any automated use of the system, such as using scripts or “bots” to contact other Users, add Users to your referral network, or solicit to other Users;
•    attempting to impersonate another User or person or business;
•    using the account, username, or password of another User at any time or disclosing your password to any third party or permitting any third party to access your account;
•    selling or otherwise transferring your profile or membership;
•    using any information obtained from the Conscious360 Services in order to harass, abuse, or harm another person or business;
•    anything that  could expose Conscious360 or its users to harm or liability;
•    displaying an advertisement on your profile that might be considered in conflict or competition with any paid Conscious360 advertisement.
9. Fees

You acknowledge that Conscoius360 reserves the right to charge for the Conscious360 Services and to change its fees from time to time in its discretion. If Conscious360 terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.
   
10. Password

You are entirely responsible for maintaining the confidentiality of your password.  You agree not to use the account, username, or password of another User at any time or to disclose your password to any third party.  You agree to notify Conscious360 immediately if you suspect any unauthorized use of your account or access to your password.  You are solely responsible for any and all use of your account.

11. Copyright Policy

You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights.  Conscious360 will immediately terminate membership privileges and remove any content posted by the User if any copyright infringement is suspected.  If you are posting material that belongs to you, and you have an agreement with a third party that the material may be viewed only through their website or service, you must obtain written, signed permission from the third party to release your material for publication or syndication on Conscious360.

12. Member Disputes

You are solely responsible for your interactions with other Conscious360 Users.  Conscious360 may monitor such disputes, and may use anything said or done as a result of the dispute as grounds for action against, or termination of, any involved Users’s account.

13. Privacy

Use of the Conscious360 Services is also governed by our Privacy Policy, which is available for viewing by clicking a link on the home page of the Conscious360 site.

14. GENERAL DISCLAIMERS

USE OF THE CONSCIOUS360 SERVICE IS AT YOUR OWN RISK.  CONSCIOUS360 IS NOT RESPONSIBLE FOR ANY INCORRECT OR INACCURATE CONTENT POSTED ON THE SITE OR IN ANY MATERIALS ASSOCIATED WITH CONSCIOUS360, REGARDLESS OF SOURCE OR CAUSE.  THE CONSCIOUS360 SERVICE, SITE OR WEBSITES, AND ALL APPLICATIONS, FEATURES, CONTENT AND MATERIAL MADE AVAILABLE ON, IN CONJUNCTION WITH OR THROUGH THE CONSCIOUS360 SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED.  TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, CONSCIOUS360, ITS SUPPLIERS, CONTRIBUTORS, LICENSORS AND PARTNERS DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED.

CONSCIOUS360, ITS SUPPLIERS, CONTRIBUTORS, LICENSORS AND PARTNERS DO NOT WARRANT THAT THE CONSCIOUS360 SERVICE WILL BE AVAILABLE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED OR THAT THE CONSCIOUS360 SERVICE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

PROFILES CREATED AND POSTED BY MEMBERS ON THE CONSCIOUS360 SITE MAY CONTAIN LINKS TO OTHER WEBSITES. CONSCIOUS360 IS NOT RESPONSIBLE OR LIABLE FOR, AND DOES NOT APPROVE OR ENDORSE ANY THIRD PARTY CONTENT, MATERIALS, WEBSITES OR APPLICATIONS MADE AVAILABLE ON OR THROUGH THE CONSCIOUS360 SERVICE.  CONSCIOUS360 IS NOT RESPONSIBLE FOR THE CONTENT, ACCURACY, AVAILABILITY, OFFENSIVENESS, OPINIONS, RELIABILITY, PRIVACY PRACTICES OR OTHER POLICIES APPLICABLE TO SUCH THIRD PARTY MATERIALS. IF YOU DECIDE TO USE OR ACCESS THIRD PARTY MATERIALS, YOU DO SO AT YOUR OWN RISK.

CONSCIOUS360 IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE CONSCIOUS360 SERVICES. CONSCIOUS360 ASSUMES NO RESPONSIBILITY FOR ANY INJURY OR DAMAGE TO USERS OR TO ANY PERSONS OR PROPERTY RESULTING FROM PARTICIPATION IN CONSCIOUS360 SERVICES. UNDER NO CIRCUMSTANCES SHALL CONSCIOUS360 BE RESPONSIBLE FOR ANY LOSS OR DAMAGE, INCLUDING PERSONAL INJURY OR DEATH, RESULTING FROM USE OF THE CONSCIOUS360 SERVICES, ATTENDANCE AT A CONSCIOUS360 EVENT, FROM ANY CONTENT POSTED ON OR THROUGH THE CONSCIOUS360 SERVICES, OR FROM THE CONDUCT OF ANY USERS OF THE CONSCIOUS360 SERVICES, WHETHER ONLINE OR OFFLINE. CONSCIOUS360 CANNOT AND DOES NOT GUARANTEE OR PROMISE ANY SPECIFIC RESULTS FROM USE OF THE CONSCIOUS360 SERVICES.

15. LIMITATION ON LIABILITY

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY CONSCIOUS360 ENTITIES OR THEIR LICENSORS, CONTRIBUTORS OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING ANY LOSS OF PROFIT DAMAGES OR LOSS OF DATA DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF CONSCIOUS360 OR AN AUTHORIZED CONSCIOUS360 REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  IN ANY CASE WHERE APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, CONSCIOUS360’S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, CONSCIOUS360’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO CONSCIOUS360 FOR THE CONSCIOUS360 SERVICES DURING THE TERM OF MEMBERSHIP.

16. Arbitration

If there is any dispute about or involving the Conscious360 Services, you agree that the dispute shall be governed by the laws of the State of Colorado, USA, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the State of Colorado, City of Denver. You further agree that all claims and disputes between you and Conscious360 that arise out of or relate in any way to the Terms of Use or your use of the Conscious360 Service will be resolved either by (a) binding arbitration by a single arbitrator in Denver County, Colorado or (b) binding non-appearance based arbitration conducted by telephone, online or based solely on written submission.  You agree to allow Conscious360 to determine what service will administer such arbitration, and you must request this information from Conscious360 in writing, and allow for a reasonable response time.  The arbitrator's award will be binding and may be entered as a judgment in any court of competent jurisdiction.  The foregoing shall not prevent Conscious360 from seeking injunctive relief in a court of competent jurisdiction.

17. Indemnity

You agree to indemnify and hold Conscious360, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Conscious360 Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the Conscious360 Website or through the Conscious360 Services causes Conscious360 to be liable to another.

18. Other

This Agreement is accepted upon your use of the Conscious360 Website or any of the Conscious360 Services and is further affirmed by you becoming a registered member. This Agreement constitutes the entire agreement between you and Conscious360 regarding the use of the Conscious360 Services. The failure of Conscious360 to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision in that or any other instance. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.  An arbitrator or court will substitute or rewrite any invalid or unenforceable term or provision to make such term or provision valid and enforceable. You consent to receiving communications and notices from Conscious360 at the email address you provide in registering for the Conscious360 Service or otherwise elect in your account settings. These Terms supersede any prior agreement between you and us regarding your use of the Conscious360 Service.
